These Terms of Service (“Terms”) govern your access to and use of the EstateView platform. By accessing or using EstateView, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using the EstateView platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using EstateView on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In that case, “you” and “your” refer to that organization.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes via email. Your continued use of the platform after such changes constitutes acceptance of the updated Terms.

2. Description of Service

EstateView is a real estate portfolio management platform that enables property investors to track, manage, and analyze their real estate holdings. Our services include:

  • Portfolio dashboard with property tracking and valuation
  • Financial management including income, expenses, and cash flow tracking
  • Tenant and lease management
  • Mortgage and loan tracking
  • Maintenance request management
  • Analytics and reporting tools including tax-ready reports
  • Document storage and management

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Account Registration

To use EstateView, you must create an account. When registering, you agree to:

  • Provide accurate information: All registration information must be truthful, accurate, and complete. You must update your information promptly if it changes.
  • Maintain password security: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Use a strong, unique password and enable two-factor authentication.
  • One account per person: Each individual may maintain only one account. Duplicate accounts may be terminated without notice.

You must notify us immediately at support@estateview.com if you suspect unauthorized access to your account.

4. Subscription & Billing

4.1 Recurring Billing

Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize EstateView to charge your payment method at the beginning of each billing cycle.

4.2 Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.

4.3 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of the next billing cycle.

4.4 Refund Policy

We offer a 30-day money-back guarantee on all plans. If you are not satisfied with EstateView within the first 30 days of your subscription, contact our support team for a full refund, no questions asked.

5. Acceptable Use

You agree not to use EstateView for any unlawful or prohibited purpose. Specifically, you shall not:

  • Engage in illegal activities: Use the platform for any purpose that violates applicable local, state, national, or international law or regulation.
  • Data scraping: Use automated tools, bots, scrapers, or other means to extract, harvest, or collect data from the platform without our express written permission.
  • Reverse engineering: Attempt to decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code of the platform.
  • Credential sharing: Share your login credentials with any other person or allow others to access your account. Team access is available through appropriate plan tiers.

Violation of these terms may result in immediate termination of your account without refund.

6. Intellectual Property

The EstateView platform, including its design, code, features, documentation, logos, and trademarks, is owned by EstateView and protected by intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for its intended purpose. This license does not grant you any ownership rights in the platform or its underlying technology.

You may not copy, modify, distribute, sell, or lease any part of our platform or its content without our prior written consent.

7. User Data

You retain full ownership of all data you input into EstateView, including but not limited to:

  • Property information and valuations
  • Financial records, income, and expense data
  • Tenant and lease information
  • Documents, photos, and files you upload
  • Maintenance records and notes

We do not claim any ownership rights over your data. You grant EstateView a limited license to use your data solely for the purpose of providing and improving our services.

You may export your data at any time through your account settings. Upon account termination, your data remains available for export for 30 days (see Section 10).

8. Disclaimers

IMPORTANT: Please read this section carefully.

  • Not financial advice: EstateView is a data management and analytics tool. Nothing on the platform constitutes financial, investment, tax, or legal advice. Always consult qualified professionals before making financial decisions.
  • Not tax advice: While we provide tools to generate tax-related reports (such as Schedule E summaries), these are provided for informational purposes only. You are responsible for the accuracy of your tax filings.
  • Not legal advice: Information provided by EstateView regarding leases, tenant management, or other legal matters is for informational purposes only and does not constitute legal advice.
  • “As is” basis: The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, EstateView and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.

In no event shall EstateView’s total liability to you for all claims arising from or related to your use of the platform exceed the total amount of fees paid by you to EstateView during the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation of liability applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise.

10. Termination

Either party may terminate this agreement at any time:

  • By you: You may cancel your subscription and delete your account at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • By EstateView: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice when possible.

Upon termination:

  • Your access to the platform will be revoked.
  • Your data will remain available for export for 30 days following termination.
  • After the 30-day period, all data will be permanently deleted from our systems.
  • Provisions of these Terms that by their nature should survive termination will remain in effect, including Sections 6, 8, 9, and 11.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.

Any disputes arising from or relating to these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
